Cancellation Policy

For Landlords:

  • Lock-in Period:
    • A mandatory lock-in period of 3 years is applicable from the date of signing the agreement.
    • During this period, neither party may terminate the agreement unless specified conditions or breaches occur.
  • Security Deposit by Landlord:
    • Landlords are required to pay a compulsory security deposit, the amount of which will be specified at the time of leasing.
    • The security deposit is refundable upon the successful completion of the agreement, subject to deductions for outstanding dues or damages (if any).
  • Cancellation During Lock-in Period:
    • If the landlord terminates the agreement during the lock-in period without valid cause, the security deposit will be forfeited.
    • Yosh Housing Solutions Pvt Ltd reserves the right to claim damages for losses incurred due to premature termination.
  • Cancellation After Lock-in Period:
    • Either party may terminate the agreement after the lock-in period with a prior written notice of 90 days.
    • The security deposit will be refunded, subject to deductions as outlined in the agreement.

For Tenants:

  • Security Deposit:
    • Tenants are required to pay a security deposit equivalent to [X months’ rent] (to be determined based on the property).
    • The security deposit is refundable upon vacating the property, subject to deductions for unpaid dues, damages, or violations of the rental terms.
  • Cancellation by Tenants:
    • Tenants must provide a 30-day written notice before vacating the property.
    • Early termination of the lease may result in a forfeiture of the security deposit, unless mutually agreed otherwise.
  • Cancellation by Yosh Housing Solutions Pvt Ltd:
    • Yosh Housing Solutions Pvt Ltd reserves the right to terminate the rental agreement with tenants for reasons including, but not limited to:
      • Non-payment of rent for more than 30 days.
      • Breach of terms and conditions outlined in the rental agreement.
      • Illegal activities or misuse of the property.
  • For Commercial Properties:
    • Specific terms for commercial properties, including notice period and deposit requirements, will be outlined in the lease agreement based on the property type and usage.

General Terms:

  • Property Maintenance:
    • Yosh Housing Solutions Pvt Ltd will handle regular maintenance and upkeep of the property.
    • Any structural damage caused by tenants will be recovered from their security deposit or claimed as additional compensation.
  • Force Majeure:
    • Neither party shall be liable for delays or terminations caused by unforeseen events such as natural disasters, government regulations, or other circumstances beyond reasonable control.
  • Dispute Resolution:
    • In case of disputes, both parties agree to resolve them amicably. If unresolved, disputes will be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with Jaipur as the arbitration venue.
